Win and Drive Raffle 2019 – Rules and Disclaimers

2019 Fundraising Raffle Rules

*Raffle runs from 10/1/2019 through 11/10/2019. Restrictions apply.

Eligibility:  The raffle is open only to legal residents of the United States who are at least 16 years of age, excluding members and immediate family members of the Walter Johnson High School Education Foundation (WJHSEF), as well as employees and their immediate family members of Hyundai Fitzgerald. 

Raffle tickets:  Eligible participants may purchase raffle tickets online only through the WJHS Education Foundation website at www.wjedfoundation.org. Tickets are $75 each or three (3) for $180.

Prize details:  One (1) winner will receive one (1) prize each. All other expenses and costs not expressly listed—including but not limited to taxes, registration, documentation fees, and any other expense or cost not expressly included above—are the winner’s sole responsibility. The winner should report the winnings for tax purposes. 

Notification: The winner will be selected in a random drawing by a third-party accounting firm on 11/10/19. The winner does not have to be present to win, but will be notified by phone and/or email. The prize must be claimed within seven (7) days of the drawing or it will be forfeited to an alternate winner.

Taxes and withholdings:  The winner will take full responsibility of the vehicle lease with Fitzgerald Hyundai. The winner is solely responsible for paying and reporting, as and when required by law, all income taxes and other taxes and expenses attributable to the prize, and shall not indemnify, defend, protect and hold harmless the WJHSEF against all claims relating to such taxes and expenses. The tax liability for the winner could be up to, but is not limited to, $3,000. The winner is advised to consult a tax consultant.

Dealership:  Fitzgerald Hyundai. Vehicle: 2020 Hyundai Elantra SE; 3-year lease; 10,000 miles per year. Fitzgerald Hyundai has the right to substitute the 2020 lease if there is a comparable 2019 vehicle available on the lot. Vehicle displayed in advertising may not be the actual vehicle leased.

Limitation of Liability/Hold Harmless Agreement:  Each person who purchases a raffle ticket and/or whose name appears on a raffle ticket order form: (a) acknowledge and agrees (for himself/herself and for every successor in interest) that the terms stated in this instrument are also conditions of the WJHSEF’s obligations hereunder, and that any obligation of the WJHSEF is limited solely to its undertaking to provide a prize to the winner of the drawing as herein provided, subject to the stated terms and conditions, and that the WJHSEF shall in no event be subject to any other obligation or liability, including but not limited to, any consequential, special or punitive damages of any kind; (b) agrees that the WJHSEF, its directors and members are not responsible for any injuries, losses or damages of any kind arising in connection with, or as a results of, this raffle and/or that person’s failure to win or redeem any prize, or that person’s award of, acceptance of, or use of, any prize; and (c) releases and agrees to indemnify, defend, protect and hold harmless the WJHSEF, its officers and members and affiliated entities from and against all losses, damages, rights, claims and actions of any kind arising in connection with, or as a result of, this raffle and/or that person’s failure to win or redeem any prize; and (d) represents and warrants to the WJHSEF that he/she has read and understands these Rules and agrees to be bound by these Rules and the WJHSEF’s decisions, which will be final.

Limited Number of Tickets:  The maximum number of raffle tickets available for sale is 1,200. If the WJHSEF does not meet the minimum number of ticket sales required for the vehicle lease, the WJHSEF reserves the right to cancel the raffle. All proceeds will be returned to the participants, unless they opt to donate the cost of the tickets to the WJHSEF.
